These Terms of Service (“Terms”) govern your access to and use of Kudos (kudos.com.my). By creating an account or using the service, you agree to these Terms.
1. The service
Kudos is a software-as-a-service platform that helps businesses collect, manage, and display customer testimonials via branded collection pages, AI-assisted WhatsApp import, embeddable widgets, and a hosted Wall of Love. Features may evolve over time at our discretion.
2. Eligibility & accounts
- You must be at least 18 years old, or of legal age in your jurisdiction, to create an account.
- You are responsible for keeping your password confidential and for all activity under your account.
- One person or legal entity may only register one account on the free plan to prevent abuse.
- You must provide accurate, current information when signing up.
3. Your responsibilities
You agree NOT to:
- Submit, fabricate, or import fake testimonials. All testimonials displayed must originate from genuine customers who actually used your product or service.
- Impersonate any person or business, or misrepresent your affiliation with any entity.
- Use the service for content that is illegal, threatening, defamatory, obscene, or infringes anyone's rights.
- Reverse-engineer, scrape, or rate-limit-bust the service or its APIs.
- Resell or sublicense the service without our written permission.
- Use Kudos to send unsolicited messages or spam your customers.
Violation of any of the above is grounds for immediate suspension or termination of your account at our sole discretion, without refund.
4. Free plan limits
The free plan is offered “as is” with the following limits:
- 1 space.
- Up to 10 text testimonials per space.
- Up to 2 video testimonials per space.
- "Powered by Kudos" watermark on collection pages and embedded widgets.
Once a limit is reached, you can’t add new testimonials in that space until you delete some or upgrade. Existing testimonials remain visible.
5. Paid plans, billing, and refunds
- Paid plans (Starter — RM29/month, Pro — RM59/month) are billed monthly via Lemon Squeezy. Prices are in Malaysian Ringgit (MYR) and exclude applicable taxes.
- You can cancel your subscription anytime from your billing dashboard. Cancellation takes effect at the end of the current billing period — no further charges, no partial refunds.
- 7-day refund: If you cancel within 7 days of your first payment, email support@kudos.com.my and we’ll refund you in full, no questions asked.
- Failed payments: if a renewal fails, we will retry for up to 7 days. If the issue isn't resolved, your account will downgrade to the free plan.
- Price changes: we may change pricing with at least 30 days’ notice by email. Existing subscriptions stay on the old price until the next renewal cycle, at minimum.
6. Intellectual property
You retain ownership of all testimonial content collected through your spaces (text, video, images, names). By submitting a testimonial through Kudos, the submitter grants the space owner a worldwide, royalty-free license to display and reproduce that content in marketing materials.
By using Kudos, you grant us a limited license to host, store, transmit, and display your testimonial content solely as needed to provide the service to you.
The Kudos name, logo, codebase, and brand are owned by us. You may not use them without permission, except to display the “Powered by Kudos” badge as automatically rendered on the free plan.
7. Termination
- You may delete your account anytime from settings. All your data is removed within 30 days (see Privacy Policy section 7).
- We may suspend or terminate your account immediately, without refund, if you breach these Terms — particularly the prohibitions in section 3.
- We may discontinue the service with at least 60 days’ notice. In that case, paid customers will receive a prorated refund of any unused portion of their current billing period.
8. Disclaimers
The service is provided “as is” and “as available”, without warranties of any kind, express or implied. We do not guarantee that the service will be uninterrupted, error-free, or that AI extractions (e.g. WhatsApp import) will be 100% accurate. You should review extracted content before approving it.
9. Limitation of liability
To the maximum extent permitted by Malaysian law, Kudos’ total aggregate liability to you for any claim arising out of or relating to the service is limited to the amount you paid us in the 12 months preceding the claim, or RM100 — whichever is greater. We are not liable for indirect, incidental, consequential, or punitive damages.
10. Changes to these Terms
We may revise these Terms occasionally. Material changes will be announced by email at least 14 days before they take effect. Continued use of the service after the effective date constitutes acceptance.
11. Governing law & disputes
These Terms are governed by the laws of Malaysia. Any dispute will be submitted to the exclusive jurisdiction of the courts of Kuala Lumpur, Malaysia, except where local consumer-protection law mandates otherwise.
